Moving Man Service Terms and Conditions
These Terms and Conditions set out the basis on which Moving Man provides removal, transport, packing, and related services within the United Kingdom. By placing a booking with Moving Man, you agree to be bound by these Terms and Conditions, which form the contract between you and Moving Man for the supply of services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Customer means the person, firm, or company who requests or receives the services from Moving Man.
Services means any removal, transport, packing, loading, unloading, storage, or associated services provided by Moving Man.
Goods means the items, belongings, furniture, equipment, or other property that you ask Moving Man to handle, move, transport, or store.
Contract means the agreement between Moving Man and the Customer for the provision of services, as evidenced by a written or verbal quotation accepted by the Customer and governed by these Terms and Conditions.
2. Scope of Services
Moving Man provides domestic and commercial removals, including local and regional moves, transport of goods, packing and unpacking, loading and unloading, and other related services as agreed in advance. The specific services to be provided, together with the estimated time and any particular instructions, will be set out in the quotation or booking confirmation.
Any additional services requested on the day of the move or after the contract has been agreed may be subject to additional charges and may only be carried out if Moving Man has the capacity and resources to do so safely and lawfully.
3. Quotation and Booking Process
All quotations are provided based on the information supplied by the Customer. This may include details about the properties involved, access conditions, the volume and nature of goods, any special handling requirements, and the dates and times requested.
Quotations may be provided following a site visit, video survey, or a description furnished by the Customer. It is the Customer’s responsibility to ensure that all relevant information is accurate, complete, and not misleading.
Unless otherwise stated in writing, quotations are valid for 30 days from the date of issue. Quotations are not binding until accepted by the Customer and confirmed by Moving Man. A booking is only confirmed once Moving Man has issued a confirmation, which may be written or verbal, and any required deposit has been received.
Moving Man reserves the right to revise or withdraw a quotation if the information provided by the Customer proves to be inaccurate or incomplete, or if there are changes in circumstances, such as altered dates, additional items, or access limitations that were not disclosed at the time of quoting.
4. Customer Obligations
The Customer agrees to:
Ensure that Moving Man has accurate and up to date information about the collection and delivery addresses, including any access restrictions, parking limitations, or specific entry instructions.
Arrange suitable parking and, where needed, secure any permits necessary for the removal vehicles at both the collection and delivery locations.
Ensure that all goods are properly packed and ready for transport unless packing services have been expressly included in the contract. Fragile or valuable items must be clearly identified and appropriately protected.
Be present, or arrange for an authorised representative to be present, at both collection and delivery to provide instructions, check inventories if applicable, and sign any relevant documentation.
Ensure that any items to be dismantled are dismantled prior to arrival if this is not part of the agreed service, and ensure that all appliances are disconnected and ready for removal.
Not present any goods for removal that are prohibited, dangerous, illegal, or unsuitable for transport as set out in these terms and in applicable law.
5. Items Not Accepted and Hazardous Goods
Moving Man does not accept for removal or transport any items that are illegal, hazardous, explosive, corrosive, flammable, or otherwise unsafe. This includes but is not limited to gas cylinders, fuel, explosives, firearms, chemicals, toxic substances, and any items prohibited under UK law or under applicable carrier and waste regulations.
Perishable goods, live animals, plants, and any items which require special environmental conditions or licences are only accepted by prior written agreement and may be refused at Moving Man’s discretion.
If such prohibited or hazardous items are presented without prior disclosure, Moving Man may refuse to carry them, suspend services, or, where required for safety or legal compliance, arrange for their lawful disposal at the Customer’s expense.
6. Waste, Disposal, and Regulatory Compliance
Moving Man operates in compliance with applicable UK waste and environmental regulations. Where services include the removal or disposal of unwanted items, rubbish, or other waste, this will be done in accordance with relevant laws and guidance for waste carriers and disposal facilities.
The Customer confirms that any items presented for disposal belong to them or that they have full authority to arrange their removal. The Customer is responsible for ensuring that no prohibited or unlawful waste is presented to Moving Man.
Moving Man reserves the right to refuse to remove or dispose of any items that appear to be controlled waste, hazardous material, or otherwise unsuitable for normal disposal routes. Any additional costs incurred as a result of handling such items, including special disposal charges or regulatory fees, will be charged to the Customer.
7. Charges and Payment Terms
Service charges are based on the quotation accepted by the Customer, together with any agreed amendments or additional services. Unless stated otherwise, prices include labour, vehicle use, and basic insurance cover as described in these terms.
Moving Man may require a deposit at the time of booking. The amount of the deposit and the deadline for payment will be communicated to the Customer during the booking process.
Remaining balances are typically due on or before the day of the move, as specified in the booking confirmation. Payment methods accepted will be notified to the Customer in advance.
Where payment terms are not complied with, Moving Man reserves the right to withhold or suspend services, retain goods until payment is received, and charge reasonable interest on overdue amounts in accordance with applicable UK legislation.
8. Cancellations, Postponements, and Delays
If the Customer wishes to cancel or postpone a booking, they must notify Moving Man as soon as reasonably possible. The effective date of cancellation will be the date on which Moving Man acknowledges the cancellation.
Moving Man may apply cancellation or postponement charges, which will reflect the notice given and any costs already incurred. Where cancellation takes place close to the scheduled service date, a higher proportion of the quoted price may be payable to cover reserved time and resources that cannot be reallocated.
Moving Man will use reasonable efforts to accommodate changes in dates or times requested by the Customer but cannot guarantee availability.
Moving Man is not liable for delays or failure to perform services caused by circumstances beyond its reasonable control. This includes but is not limited to severe weather, road closures, traffic incidents, mechanical breakdowns, strikes, accidents, or compliance with police or regulatory instructions. In such cases, Moving Man will make reasonable efforts to complete the services as soon as reasonably practicable or agree an alternative arrangement with the Customer.
9. Access, Property Conditions, and Parking
The Customer must ensure that Moving Man has safe and reasonable access to both collection and delivery locations, including clear paths, suitable parking spaces, and any necessary permits or authorisations.
If there are access issues such as narrow roads, height or weight restrictions, limited parking, or internal obstacles like tight staircases, low ceilings, or unstable flooring, the Customer must inform Moving Man in advance.
Where access difficulties cause additional time, require extra staff, or necessitate alternative equipment or transport methods, Moving Man may apply additional charges. Moving Man may refuse to proceed with any part of the service that it considers unsafe or likely to cause damage to property or goods.
10. Liability for Loss or Damage
Moving Man will exercise reasonable care and skill in the handling, packing, loading, transport, and unloading of goods. However, the Customer acknowledges that some risk of loss or damage is inherent in removal and transport services.
Moving Man’s liability for loss of or damage to goods, where such loss or damage arises from Moving Man’s negligence or breach of contract, will be limited to a reasonable and proportionate amount, taking into account the value of the goods and the level of charges for the services. Specific limits or insurance cover details may be set out separately in the quotation or booking documentation.
Moving Man is not liable for loss or damage arising from the following:
Defective or inadequate packing by the Customer where packing services are not provided by Moving Man.
The natural deterioration, wear and tear, or fragility of items that are not reasonably robust for normal handling and transport.
Pre existing damage, defects, or instability of furniture or other items.
Loss or damage to items such as cash, jewellery, watches, precious metals, stones, important documents, or items of special value unless such items were expressly declared, agreed in writing, and handled under a specific arrangement with enhanced cover.
Loss or damage caused by vermin, moths, infestation, or the inherent nature of the goods.
Indirect or consequential loss, such as loss of profit, business interruption, or emotional distress, whether or not such loss was foreseeable.
11. Claims and Time Limits
Any visible loss or damage to goods or property must be reported to Moving Man as soon as reasonably possible, ideally on the day of the service or within a short period afterwards. The Customer should provide details of the items involved, the nature of the damage, and relevant evidence such as photographs.
All claims must be submitted within a reasonable time frame from the date of the services being carried out. Moving Man may not be obliged to consider claims made after a long delay where it becomes difficult to investigate the circumstances or determine responsibility.
The Customer must allow Moving Man a reasonable opportunity to inspect any alleged damage and, where appropriate, to arrange for repairs, replacements, or a fair settlement in line with the applicable liability limits.
12. Insurance
Moving Man maintains appropriate insurance in relation to its business activities. Basic cover limits may apply to the value of goods carried. Further details of coverage and any applicable excess or exclusions are available on request.
The Customer is encouraged to consider taking out additional insurance for high value or particularly fragile items. If the Customer arranges separate insurance, they remain responsible for any premiums and compliance with the policy conditions.
13. Storage Services
Where Moving Man provides storage, goods will be stored with reasonable care and appropriate security measures. Storage charges and conditions, including access arrangements and notice periods, will be set out in the storage agreement or quotation.
Storage is provided on the condition that the Customer has full title or authority in relation to the goods and that the goods do not include any prohibited or hazardous items.
14. Data Protection and Privacy
Moving Man will collect and process personal data such as names, addresses, and contact details for the purpose of booking and delivering services, administering accounts, and complying with legal obligations. Personal data will be handled in accordance with applicable UK data protection laws.
Your information will not be sold to third parties. It may be shared with trusted partners or subcontractors only where necessary to deliver the services or comply with legal requirements.
15. Subcontracting
Moving Man may, at its discretion, use trusted subcontractors or partner companies to carry out part or all of the services. Moving Man will remain responsible for the proper performance of the contract and will take reasonable steps to ensure that any subcontractors meet appropriate standards.
16. Complaints and Dispute Resolution
If the Customer is dissatisfied with any aspect of the services, they should raise their concerns with Moving Man as soon as possible so that an investigation can be carried out and, where appropriate, remedial action taken.
Moving Man aims to resolve complaints promptly and fairly. If a dispute cannot be resolved directly, the parties may consider using mediation or another form of alternative dispute resolution before resorting to court proceedings.
17. Amendments to These Terms
Moving Man may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to your contract unless otherwise agreed in writing.
18. Governing Law and Jurisdiction
These Terms and Conditions and any contract between Moving Man and the Customer are governed by the laws of England and Wales. Any disputes arising out of or in connection with the contract or these terms will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory rights that consumers may have under applicable law.
By confirming a booking with Moving Man, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
